Terms of Service

These Terms of Service ("Terms") govern your access to and use of the InTouch website, dashboard, browser extension, and related services (collectively, the "Services"), which are operated by WebornHub LLC ("WebornHub LLC," "InTouch," "we," "us," or "our"). By using the Services, you agree to these Terms.

1. Accounts and Access

• You are responsible for the accuracy of account information you provide.
• You are responsible for maintaining the confidentiality of your credentials and for activity under your account.
• You must promptly notify us if you suspect unauthorized access to your account.

2. Subscriptions, Billing, Cancellation, and Refunds

• Paid plans are billed on a recurring basis according to the plan you select.
• By subscribing, you authorize us and our payment processors to charge applicable fees and taxes.
• You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing cycle.
• Refund requests are reviewed case by case. To request a refund, contact us at intouchcopilot@gmail.com.
• We may change pricing from time to time and will provide notice for material pricing changes before renewal where required.

3. Acceptable Use

You agree not to:

• Use the Services for unlawful, fraudulent, or deceptive activity.
• Infringe, misappropriate, or violate intellectual property, privacy, publicity, or other rights.
• Interfere with or disrupt the Services, including by introducing malicious code or attempting unauthorized access.
• Reverse engineer, scrape, or extract data from the Services in violation of applicable law or these Terms.
• Use the Services to send spam or other unauthorized communications.

4. Your Content

You retain ownership of content you submit to the Services ("User Content"). You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, and display User Content as needed to provide, secure, and improve the Services.

5. Intellectual Property

The Services, including software, branding, and related content (excluding User Content), are owned by WebornHub LLC or its licensors and are protected by law. Subject to these Terms, we grant you a limited, non-transferable, non-exclusive license to use the Services for your internal personal or business use.

6. Service Availability and Changes

We may modify, suspend, or discontinue all or part of the Services at any time. We do not guarantee uninterrupted or error-free operation.

7. Disclaimer of Warranties

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by law, WebornHub LLC and its affiliates, officers, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from or related to the Services.

To the maximum extent permitted by law, our aggregate liability for all claims related to the Services will not exceed the amounts you paid to us for the Services in the twelve (12) months preceding the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold harmless WebornHub LLC and its affiliates, officers, employees, and agents from and against claims, liabilities, damages, losses, and expenses arising from your violation of these Terms or misuse of the Services.

10. Termination

We may suspend or terminate your access to the Services if you violate these Terms, if required by law, or to protect the Services and users. You may stop using the Services at any time.

11. Governing Law and Venue

These Terms and any dispute arising out of or relating to these Terms or the Services are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

You and WebornHub LLC agree that exclusive venue for any dispute will be the state or federal courts located in Delaware.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms become effective when posted unless otherwise stated. Your continued use of the Services after an update constitutes acceptance of the updated Terms.
